Nothing in these terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded, including those under the Australian Consumer Law.

1. General Use

• We aim to keep information accurate and current, but errors or omissions may occur. This does not affect your rights under the Australian Consumer Law.

• You must not use our website unlawfully, interfere with its operation or attempt to access information you are not authorised to access.

2. Orders & Payments

• All orders are subject to acceptance and product availability.
• Prices are listed in Australian dollars (AUD) and include GST where applicable.
• Full payment must be received before goods are dispatched.
• If we cannot fulfil your order, we will contact you and refund any payment for goods we cannot supply.

3. Shipping & Delivery

• We aim to dispatch orders promptly. Shipping times are estimates only and may vary.
• We use third-party carriers to deliver orders. Delays outside our control may occur.
• If your order is delayed, lost or arrives damaged, please contact us so we can assist.
• Nothing in this section limits our obligations or your rights under the Australian Consumer Law.

4. Returns & Refunds

• Any conditions applying to change-of-mind returns do not limit your rights for faulty goods or other remedies available under the Australian Consumer Law.

5. Consumer Guarantees

• Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
• You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
• You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

6. Promotions, Discounts & Coupon Codes

• Waladi may offer quantity discounts, coupon codes and other promotional offers.
• Eligibility, expiry dates, usage limits and exclusions will be stated with each offer.
• Unless an offer states otherwise, separate promotions and coupon codes cannot be combined or applied to past orders.
• Published quantity discounts apply according to their stated conditions, including where those conditions allow discounts on sale items.
• Coupon codes must be entered at checkout.
• Promotions are subject to availability. Changes to an offer will not alter an order we have already accepted.
• We may refuse a promotion where its stated eligibility requirements have not been met. If this affects an order you have paid for, we will contact you to resolve it or arrange a refund.
• Promotions and coupon codes do not affect your rights under the Australian Consumer Law.

7. Limitation of Liability

• To the extent permitted by law, Waladi excludes liability for indirect or consequential loss arising from use of our website, products or services.
• This exclusion does not apply to any liability that cannot lawfully be excluded, including liability under the Australian Consumer Law.

13. Customer Reviews, Photos & Videos

Permission to publish and use your content

By submitting a review and accepting these Terms & Conditions, you grant Waladi a non-exclusive, worldwide, royalty-free licence to reproduce, publish, display and share your review, rating, chosen display name and any photos or videos submitted with it for the following purposes:

• Displaying customer reviews on our website.
• Sharing customer experiences on our social media accounts.
• Promoting Waladi and its products through paid advertisements, marketing emails and printed promotional material.

You retain ownership of your content. This permission allows Waladi to use it without paying royalties or other compensation. You remain free to use your content yourself or give others permission to use it.

We may allow our agencies, service providers and publishing platforms to process and display your content as needed for these purposes.

We will not publish your email address as part of your review. Permission to use your review does not subscribe you to marketing emails or SMS messages.

Content ownership and permission from others

By submitting content, you confirm that:

• Your review reflects your honest experience.
• You own the content or have permission from the rights holder to grant the licence described above.
• Anyone identifiable in your photos or videos has been informed of the uses described in this section and has given permission for those uses.
• For any identifiable child, you are their parent or legal guardian with authority to give permission, or have obtained permission from someone who has that authority.

Do not upload content containing music, images or other material you do not have permission to use for these purposes.

Where further permission is required by law, Waladi will obtain it before using the relevant content.

Formatting and editing

We may resize, crop or format photos and videos, add captions, or use accurate excerpts from reviews to suit the permitted placement.

We will not change the meaning of your review, remove context in a misleading way or misrepresent your experience.

Review moderation and incentives

We may moderate submissions for spam, unlawful material, privacy concerns, abusive language or content unrelated to the product or experience.

If we offer an incentive for leaving a review, it will apply regardless of whether the review is positive or negative.

Withdrawing permission or requesting removal

You may withdraw permission for future promotional use or request removal of your review, photos or videos by contacting Waladi through our website. Please provide enough information for us to identify your submission.

Once we receive and identify your request, we will:

• Stop new promotional use of the relevant content.
• Remove the relevant content from website and promotional placements we control within a reasonable time.
• Instruct service providers acting on our behalf to stop the relevant use.
• Stop distributing printed promotional material containing the relevant content.

We cannot recall printed material already distributed or guarantee removal of copies independently downloaded, cached or shared by others. This does not limit our obligations under applicable law.

We may retain records of your submission and permission where reasonably necessary for legal, administrative or compliance purposes, as explained in our Privacy Policy.
